At Kay Orchid Flask Factory, although we constantly strive to ensure customer satisfaction, our ability to fulfill your order remains dependent on product availability. In the unfortunate but possible event that an item in your order encounters a supply issue that we are unable to resolve quickly, all related payments will be fully refunded within 30 days.
Kay Orchid Flask Factory reserves the right to refuse any order. In the unlikely event that this occurs, any related payment will be fully refunded using the same payment method originally used, and any pending payment will be canceled.
Taxes
All prices provided by Kay Orchid Flask Factory are net prices, as the business model of Kay Orchid Flask Factory is not subject to VAT. Please note that your order may be subject to taxes upon entering its destination country (outside the EU), and these taxes are not included in the net amount charged by Kay Orchid Flask Factory.
It is entirely your responsibility to ensure that all applicable taxes relating to your order are properly declared and paid. To avoid any unpleasant surprises, we strongly recommend contacting your local customs authorities before placing your order.
Furthermore, professional customers will not receive special pricing. Any discount may be granted depending on the total order amount.
Placing an Order
This website has been designed to make ordering our products as simple and convenient as possible. You will be guided clearly throughout the ordering process and will be required to provide accurate and complete personal information, including your address and postal code, as well as those of the recipient (if different from yourself), together with all information necessary for payment.
Please use only Western characters to ensure proper delivery. Payment may be made by credit card, bank transfer, check, or PayPal. For other payment methods, please contact us through the contact form.
Payment by check is only accepted for checks issued by French banks. Any fees related to incoming bank transfers will be at your expense.
Please note that all orders must be fully paid before shipment. No exceptions will be made. Companies and educational institutions are also subject to this rule.
Once submitted, your order will be processed by our services. We will send a confirmation email to the email address provided during the ordering process. No contractual agreement shall exist until this confirmation email has been issued.
If you wish to combine your order with products available on our eBay account, this is possible. Please contact us before placing and paying for your order.

Order Modification
If you wish to modify your order, please contact us by email before shipment. We will always try to accommodate last-minute changes, but we can only guarantee modifications made within 24 hours after your order confirmation email has been sent.
Order Cancellation and Right of Withdrawal
If you wish to cancel an order, please contact us by email. Orders may only be canceled within 24 hours following confirmation by email from Kay Orchid Flask Factory. In such cases, all payments made will be fully refunded using the same payment method originally used, and any pending payments will be canceled.
In accordance with French consumer law (“Hamon Law”), you have a 14-day withdrawal right after receiving your order, except for perishable goods, custom-made products, personalized goods, plants, phytosanitary products, culture media, etc.
Returned products must be identical to their condition upon receipt (photos and packaging serving as proof). Return shipping costs remain the responsibility of the customer.
Pre-orders and Exhibitions
During exhibitions, you may place a pre-order and collect it on the day of the event. A 10% deposit of the total amount will be required and is non-refundable in case of absence or cancellation.
Delivery Issues
To avoid delivery problems, please ensure that when placing your order you provide your phone number, email address, and those of the recipient (if different from yourself), so that postal services may contact you if necessary.
Kay Orchid Flask Factory cannot be held responsible for delays caused by incorrect or incomplete delivery information.
Delivery times are provided as estimates according to the carrier. In case of delay or late delivery, Kay Orchid Flask Factory cannot be held responsible. However, as some carriers include insurance, a claim may be opened to potentially provide a discount voucher where applicable. Each case will be reviewed individually.
Only shipments with tracking options may be subject to claims in case of non-delivery and may possibly be compensated depending on the reasons provided by the postal service.
We ship products worldwide. If you cannot enter your address or place an order through the website, please contact us.
Plants may be subject to import/export restrictions in certain countries. Please contact us before ordering. In case of spontaneous orders blocked by customs, no refund will be issued.
Shipping and Local Pickup
Orders are mainly processed during weekends (except during exhibitions or events, which will be indicated on the website).
In case of public holidays, bridge holidays, or exhibitions, orders will be processed the following week.
Please note that deliveries are made all year round. If weather conditions are unsuitable, we may hold your order until further notice. Your order status will then be updated to “on hold due to unfavorable weather conditions” and shipped once temperatures become suitable again.
If you still wish to receive your order despite unfavorable conditions, you assume full responsibility for it and no compensation will be granted in case of issues affecting plants/flasks. Kay Orchid Flask Factory cannot be held responsible for damage or mortality caused by transportation and/or temperatures.
Flasks generally arrive with scattered agar and should be removed immediately or replanted within a maximum of 2 days.
For local pickup, collection is by appointment only at the indicated address (please contact us beforehand). Visitors are not permitted inside the premises.
Delivery times vary depending on the carrier.
The delivery times displayed on the website correspond solely to the carrier’s estimated transit times after the parcel has been shipped. They do not include the time required for order processing, preparation, packaging, and organization by Kay Orchid Flask Factory.
All delivery times are provided for informational purposes only and begin from the actual handover and acceptance of the parcel by the carrier. Kay Orchid Flask Factory cannot be held responsible for delays related to transportation, peak periods, weather conditions, customs procedures, or any circumstances beyond our control.
For shipments outside France, an appropriate logistics provider may take over the package, and delivery times may vary accordingly.
If you modify the delivery point while the parcel is already in transit and/or ready to ship, please contact us and/or the desired carrier service.
For customers outside France, shipments containing live goods (plants/flasks) may be sent via Colissimo, but the condition upon arrival cannot be guaranteed and no compensation will be provided in case of deterioration caused by shipping duration and/or outdoor temperatures.
In case of returned parcels (unclaimed, incorrect address, etc.), if you are not responsible, the parcel will be resent or fully refunded. In case of customer error, only the products will be refunded and/or resent once shipping fees are paid again.
Note: Packages containing plants and/or flasks are considered live goods. Their viability during transportation cannot be guaranteed.
In cases of frost or extreme heat, damage may occur and we cannot be held responsible.
Abusive Behavior
Any abusive behavior is unacceptable according to the operating standards of Kay Orchid Flask Factory. We make every effort to process your orders with the utmost care and diligence, but human errors may occasionally occur. Placing an order with Kay Orchid Flask Factory does not authorize anyone to treat our staff abusively.
If such behavior occurs, we reserve the right to suspend the transaction until respectful behavior is restored. We also reserve the right to refuse service to anyone who has demonstrated such behavior in the past.
Updates to the Terms
We may update these Terms by publishing a new version on our website. We encourage you to check this page regularly to ensure you remain satisfied with them. We may also notify you of changes by email.
